St. Louis County Man Found Not Guilty of DWI

A St. Louis County man was charged with DWI after allegedly driving nearly 100 miles per hour and weaving in and out of traffic. The officer claimed our client was confused, smelled like alcohol, had slurred speech, and failed the first field sobriety and then refused the rest as well as beathalyzer. We forced the officer to admit that he wrote in his report that he smelled alcohol coming from the car, not our client’s beath; that our client had a low voice and New York accent and the officer wore hearing aids because he couldn’t low tones; that the field sobriety test was not conclusive; and that he told our client that an attorney would tell him not to take the breathalzer. The jury returned a not guilty verdict in less than 30 minutes.
