.14 BAC DWI Dismissed

Client was charged with DWI in St. Louis City after allegedly failing all Field Sobriety Tests, admitting to drinking, and blowing a .14 in a breath test machine. In a pretrial hearing, we persuaded the judge that the breath test was not adminstered correctly. The judge threw out the breath test results, which resulted in a complete dismissal.

Felony DWI/Assault Reduced

Client was charged with Assault 2nd DWI after allegedly flipping a car, which resulted in the passenger's being severed. According to hospital records client had a BAC above 2.0. We were able to persuade the prosecutor to reduce the charges to a misdemeanor, by attacking the reliability of the hospital blood tests.

DWI Accident Dismissed

Client was charged with DWI after rear-ending and totaling another car, failing all field sobriety tests, and blowing above the legal limit. In a pre-trial hearing we were able to show that the officer had performed the Field Sobreity Tests incorrectly and that the breath test (.08) could not prove that client was impaired at the time of driving. Client pled to minor traffic violations and paid a fine, but DWI was completely dismissed.
